States take Big Steps in Psilocybin Legalization

Psilocybin remains a Schedule I controlled substance under US federal law, prohibiting all use, but the legal landscape is shifting rapidly toward decriminalization and therapeutic access. Oregon and Colorado have legalized professional, supervised use and legalized/decriminalized possession, while many cities have deprioritized enforcement. And hurray for New Hampshire which just advanced HB 1809.

Key Aspects of the Legal Landscape in New England:

  • In February 2026, the New Hampshire House advanced HB 1809, a bipartisan bill aimed at legalizing the medical use of psilocybin in a "Provider-Producer" Model: The bill allows licensed medical providers to also grow and harvest their own psilocybin products for use with patients. New Hampshire seeks to legalize therapeutic use, for treating severe mental health conditions (PTSD, treatment-resistant depression) in a supervised setting. The bill has passed the House and is currently undergoing review regarding funding (House Finance Committee). Prior attempts to decriminalize adult possession (HB 528) were tabled in 2025 in favor of the therapeutic mode

  • In New York, multiple bills are active in the 2025-2026 legislative session, including NY S00495 and A03581-A, which aim to legalize and regulate medical psilocybin. The proposed bills would authorize psilocybin in clinical settings under the supervision of certified facilitators. A0628 seeks to remove psilocybin from the list of Schedule I controlled substances and legalize adult possession.

  • In May 2025, the Connecticut House passed HB 7065, a bill to decriminalize the possession of small amounts of psilocybin. The bill aims to treat possession of less than half an ounce as a civil infraction ($150 fine) rather than a crime. A 2022 law (Public Act 21-26) already required the state to study the health benefits of psilocybin and establish a therapeutic pilot program, which is in progress.

  • And New Jersey is not seeking to decriminalize or legalize psilocybin usage, A new 2026 bill advocates for clinical access only. It establishes a, tightly controlled, research-focused framework where psilocybin will be administered in designated hospitals (one in each of the northern, central, and southern regions).
